  1. Acceptance of Terms
    By accessing and using the website https://grandoak.co.za, you agree to be bound by these Terms and Conditions, our Privacy Policy, and any other applicable laws and regulations. If you do not agree, you must not use this site.
  2. About Grand Oak Auctions
    Grand Oak Auctions is an auction house that holds live onsite and online auctions with an online platform for the listing, promotion, and auctioning of machinery, equipment, and related assets. We act as a facilitator between sellers and buyers and do not take ownership of the listed items unless otherwise stated.
  3. Eligibility
    Users must be 18 years or older and have the legal capacity to enter into binding contracts. Businesses must be duly registered and authorized to transact.
  4. Registration and User Accounts
    You are required to create an account to participate in auction.
    You are responsible for maintaining the confidentiality of your login credentials.
    Grand Oak Auctions reserves the right to suspend or terminate accounts that violate these terms.
  5. Listing and Selling
    Sellers must ensure that all information provided about listed assets is accurate, complete, and not misleading.
    By listing, the seller confirms they have the right to sell the item and that it is free from liens.
    Grand Oak Auctions may charge listing, marketing, and/or administrative fees as per our current pricing policy.
    Sellers agree to comply with all applicable South African laws and regulations.
  6. Bidding and Buying
    Bids placed during an auction are legally binding.
    The highest bidder, upon meeting any reserve price, will be deemed the purchaser.
    Buyers are responsible for understanding all fees, taxes, transport, and risks related to a purchase.
    Grand Oak Auctions reserves the right to cancel, suspend, or extend any auction at its sole discretion.
  7. Payment Terms
    Payment is to be made on the day of the auction.
    Late or non-payment may result in account suspension and legal recovery.
    Terms: EFT , Direct cash deposit, Credit or Debit card. No cash or cheques will be accepted at the auction site. Cash handling fee of 1.5% will apply for direct cash deposits and 2.5% for credit or debit cards. No bank charges will apply for EFT payments.
    All prices are quoted in ZAR (South African Rand) unless otherwise stated.
  8. Warranties and Disclaimers
    All items are sold “as is, where is” unless otherwise stated in the listing.
    Grand Oak Auctions makes no warranties or representations regarding the accuracy of listings or condition of items.
    We disclaim liability for any loss or damage arising from transactions conducted through the platform.
  9. Limitation of Liability
    Grand Oak Auctions shall not be liable for:
    Any indirect, consequential, or incidental damages;
    Loss of profits, business, or data;
    Actions taken by third-party sellers or buyers;
    Any delay or failure in performance due to causes beyond our reasonable control.
  10. Termination and Suspension
    We reserve the right to suspend or terminate your access to the platform for any breach of these Terms or for any reason deemed appropriate by Grand Oak Auctions.
  11. Privacy
    Your use of this site is also governed by our Privacy Policy which outlines how we collect, store, and process personal data.
  12. Intellectual Property
    All content, trademarks, logos, and software on this site are the property of Grand Oak Auctions or its licensors. Unauthorised use is strictly prohibited.
  13. Governing Law
    These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Disputes shall be subject to the exclusive jurisdiction of South African courts.
